Any person logging onto any of the data contained on this site agrees to be bound by the Terms and Conditions set out herein. The information posted on this site is the property of the respective BC’s and the control of the information is at their sole discretion.

Nothing on this page must be seen as legal advice. We strongly advise that the T seek legal Council before allowing 3rd parties access to their Data.

We do not accept responsibility for the accuracy of any Data sent to us nor will we ever become involved in any dispute between Owners, the T or MA.

1 PRICING.

The rental fee per Complex is calculated at R4.25 per unit with a minimum fee of R50.00 pm.  Database maintenance is R300.00 pm.

2 ACCESS BY MANAGING AGENT.

The MA will have free access.

3 PAYMENT.

The monthly rental of the storage space and the fee for the Data Maintenance is payable by no later than the 7th day of every month.

4 NON-PAYMENT.

CM may suspend an account due to non-payment or any breach of the terms and conditions set out herein after the BC has been given written notice to rectify the breach within 5 days from the date of dispatch of the notice.

5 CANCELLATION. 

Either party may cancel this agreement by giving the other party 2 calendar month’s written notice.  In the event that the agreement is cancelled, and all fees have been paid, the T will be required to remove all their Data within 30 days of the last day of the notice period.

6 ADVERTISING INCOME.

Each Complex will be provided with 12 advertising slots. Six are for the sole use of CM and six are for the BC.  The BC may rent out these 6 spaces and any rental income shall belong to the BC.  CM will not be involved in any Rental negotiations.

 7 DATA AND USE THEREOF.

All data is to be sent to CM by the designated person at the BC.  CM undertakes that all data will be uploaded within 3 weeks of receipt. CM will not correspond with the MA directly. As CM has no control over the use of any of the data downloaded by Owners or other Parties, we can never be held responsible for any actions which may arise from the improper use of the data by these parties. 

8 INFORMING THE OWNERS (MEMBERS)

 The BC must inform the owners of the Agreement with CM and how the additional expenditure is to be financed from the date of implementation till the next AGM.

9 OWNERSHIP OF THE DATA.

All Data uploaded to CM is the sole property of the BC.

10 LEGAL NOTICE AND OWNERSHIP.

CM own all rights in this website and reserve the right to update the system and user interface as deemed necessary. We may change any of these terms of use at any time by updating this web page. Our trademarks are our property and you may not use them without our written permission. All other trademarks are their respective owners' property.

11 RESTRICTIONS.

You may not frame, change, hire out, reverse engineer, or copy this website under any circumstances. You use this website at your own risk and we make no warranties about it.

12 BREACH.

We may cancel your Rental Agreement if you breach any of the above terms and conditions and do not rectify the breach within 5 days of receipt of written notice from CM.

13 INDEMNITY. 

You indemnify us against any liability related to your use of this website. Our maximum liability to you for all claims for direct damages related to this website is ZAR100. We will never be responsible for any indirect damages.
